Eligibility and Account Registration

Eligibility to Access Our Services:

  • You must be at least 18 years old and legally capable of entering into binding contracts.
  • You must operate a legitimate business that complies with all applicable laws and regulations.
  • During onboarding, you are required to complete our KYC (Know Your Customer) verification by providing valid business documents and proof of identity.
  • You are solely responsible for maintaining the confidentiality of your account credentials. Any activity conducted through your account will be considered authorized by you unless proven otherwise.
  • We reserve the right to approve or reject your application at our sole discretion.
Scope of Services

Iconcept Contact Solution provides digital payment processing solutions that allow businesses to accept payments from customers via multiple channels, including credit and debit cards, UPI, net banking, and digital wallets. We offer integration tools such as APIs and plugins for websites, mobile applications, and POS systems. Additional features may include payment links, subscriptions, invoicing, QR code payments, and real-time transaction reporting. Funds are settled into your verified bank account, and we may update or enhance our services as required.

We reserve the right to modify, add, or discontinue any services at our discretion.

User Obligations

As a user, you agree to:

  • Provide accurate and up-to-date business and financial information.
  • Use the platform solely for lawful business purposes.
  • Keep your login credentials and API keys confidential.
  • Promptly notify us of any unauthorized access, suspected fraud, or account compromise.
Fees and Settlement

Fees and Charges:

Fees for our Services are specified in your Merchant Agreement or displayed on your Dashboard. We reserve the right to revise fees with prior notice. All fees are exclusive of applicable taxes unless otherwise indicated, and you are responsible for remitting any applicable taxes to the relevant authorities. You are also liable for any chargebacks initiated by customers, and refunds will be processed in accordance with our internal policies and timelines.

We may update or amend our fees at any time, with such changes communicated via email or your Dashboard.

Prohibited Activities

You are strictly prohibited from using our Services for any illegal, fraudulent, or unauthorized activities. This includes, but is not limited to, the sale or distribution of narcotics, adult content, gambling services, counterfeit goods, firearms, or any products or services prohibited by applicable law. You must not manipulate the platform, bypass security measures, or exploit vulnerabilities. Any violation of this provision may result in immediate account suspension, withholding of funds, and potential legal action under applicable laws.

Risk Monitoring and Fraud Management

We employ real-time transaction monitoring, AI-driven fraud detection tools, and automated risk-scoring algorithms to safeguard both merchants and end users. Transactions flagged as potentially suspicious may be delayed, held for review, or reversed. In cases of confirmed fraudulent activity, we reserve the right to suspend or terminate your account, with or without prior notice. You acknowledge and accept responsibility for chargebacks, financial losses, or regulatory penalties arising from illegal or high-risk activities conducted through your account.

Data Privacy and Security

We are committed to safeguarding both your data and that of your customers. All personal and transactional information collected through our Services is handled in compliance with applicable data protection laws and our Privacy Policy. We adhere fully to security standards and implement robust encryption, authentication, and access control measures to protect sensitive data.

By using our Services, you consent to the processing of your data for purposes such as payment processing, fraud prevention, technical enhancements, and legal compliance. Under no circumstances should you store cardholder data on your systems unless explicitly permitted under the relevant security regulations.

Intellectual Property

All intellectual property associated with the platform, including but not limited to software code, interface design, brand name, trademarks, logos, textual content, and user documentation, remains the exclusive property of ICONCEPT CONTACT SOLUTIONS PVT LTD or its licensors. You are granted a limited, non-transferable, and non-sublicensable license to use the platform solely for its intended business purposes.

You may not copy, modify, reverse engineer, sublicense, or otherwise exploit any part of the platform without prior written consent. Any use of our branding or marketing materials must also receive explicit written approval.

Third-Party Services

Our platform may connect with external systems or third-party service providers, including banks, payment networks, logistics services, analytics tools, and customer relationship management platforms. We do not control these third-party services and are not responsible for their performance, data practices, or service interruptions. Any loss or damage resulting from your use of such integrations is your responsibility and subject to the terms and policies of the respective third parties.

Termination & Suspension

We may suspend or terminate your access to our Services at any time if we determine that you have violated these Terms, engaged in suspicious activity, or are required to do so by law or regulatory authorities. Such suspension may be temporary or permanent depending on the nature and severity of the breach. Upon termination, all pending settlements, obligations, and dues must be fulfilled. We reserve the right to retain your funds during any investigation or until the matter is fully resolved.

Dispute Resolution

In case of any disputes, our internal support and dispute resolution team will initially attempt to resolve the matter amicably. For transaction-related issues, including chargebacks, we will coordinate with acquiring banks and card networks in accordance with applicable protocols. If the dispute remains unresolved, you may pursue legal remedies under the governing law and jurisdiction specified below.

Limitation of Liability

To the fullest extent permitted by applicable law, Iconcept Contact Solution shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our Services. This includes, but is not limited to, loss of business, revenue, or data. We do not guarantee uninterrupted service, nor can we ensure that every transaction will be processed without error or delay.

Indemnification

You agree to indemnify, defend, and hold harmless ICONCEPT CONTACT SOLUTIONS PVT LTD, including its directors, employees, and affiliates, from any claims, liabilities, damages, losses, or legal expenses arising from your use or misuse of the Services, violation of these Terms, or any unlawful or fraudulent activities conducted through your account.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these Terms shall fall under the exclusive jurisdiction of the courts located within India.

Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms due to circumstances beyond our reasonable control. Such events include, but are not limited to, natural disasters, pandemics, wars, acts of terrorism, cyberattacks, technical outages, strikes, or government-imposed restrictions.

Amendments and Modifications

We reserve the right to modify, amend, or update these Terms at any time. Any significant changes will be published on our website with an updated "Last Updated" date. Your continued use of the Services following such updates constitutes acceptance of the revised Terms. It is your responsibility to review the Terms periodically for any changes.

Severability and Waiver
